1. Agreement to Terms
By accessing or using Certainium's web platforms, simulation engines (including `phor-see`, `phor-tell`, `phor-warn`, and `phor-tune`), APIs, and Remote MCP tools, you agree to be bound by these Terms of Service. If you are entering into this agreement on behalf of a company or other legal entity, you represent that you have the authority to bind such entity.
2. Service Usage & Fair Compute Limits
Certainium provides stochastic computational modeling and AI executive advisory. Customer accounts are allocated monthly simulation quotas according to their selected subscription tier. You agree not to abuse, reverse engineer, or intentionally overload the computational clusters or Remote MCP endpoints.
3. Proprietary Rights & Intellectual Property
You retain full, exclusive ownership of all scenario data, proprietary business spreadsheets, custom distribution constraints, and internal operational metrics uploaded to Certainium. Certainium and its licensors retain all rights, title, and interest in and to the platform, simulation algorithms, and proprietary software twins.
4. Decision Intelligence Disclaimer
Certainium generates probabilistic mathematical simulations, tail-risk projections, and AI-synthesized advisory memos to assist in decision analysis. These outputs do not constitute formal investment, legal, tax, or actuarial advice. Management remains solely responsible for corporate actions, investments, and capital commitments.
5. Governing Law
These Terms shall be governed by and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of law provisions.
